High rate of success makes Medicare disputes worth appealing

Only about 10 percent of all legal cases are reversed according to Ruggero Aldisert, a federal appeals judge.  Even worse, an appeal over social security disability benefits wins in only 2 percent to 3 percent of cases.  So you might think it likely that Medicare appeals would also have low rates for reversal but not so says the Medicare Rights Center, a national nonprofit organization.  “If Original Medicare will not pay for care you received, you will find this out when you receive your Medicare Summary Notice (MSN).  If you think the care you received is medically necessary, you should not take no for an answer.”  According to an article on ElderLawAnswers.com as many as 92 percent of Part B appeals are reversed.
